Terms of Service

These Terms of Service ("Terms") govern the use of the Loaded mobile application and the loaded.fit website (hereinafter "the Service"). By using the Service, you accept these terms in their entirety.
1. Description of the Service
Loaded is a sports and nutrition tracking application that allows users to monitor their training, nutrition, sleep and physical progression. The application also provides coaching, community and AI-based analysis features.
2. Registration and Account
- You must be at least 16 years old to create a Loaded account.
- You are responsible for the confidentiality of your login credentials.
- The information provided at registration must be accurate and up to date.
- Only one account per person is allowed.
- Loaded reserves the right to suspend or delete an account in case of breach of these Terms.
3. Subscriptions and Payments
3.1. Available offers
Loaded offers a free version with basic features, as well as paid subscriptions:
- Loaded Premium — €9.99/month: access to all advanced features (analytics, unlimited programs, SmartCoach AI, etc.)
- AI Scans Pack — €4.99/month: 10 AI nutritional scans per day
3.2. Auto-renewing subscriptions
Subscriptions are auto-renewing. Payment will be charged to your Apple ID account at confirmation of purchase. The subscription renews automatically at the end of each period unless you cancel it at least 24 hours before the end of the current period.
3.3. Management and cancellation
- You may manage and cancel your subscriptions in your Apple device Settings → your Apple ID → Subscriptions.
- Cancellation takes effect at the end of the current period. You retain access to Premium features until that date.
- No refund is granted for the current period after cancellation.
- Any unused portion of a free trial period will be forfeited when you purchase a paid subscription.
3.4. Price changes
Loaded reserves the right to modify subscription prices. In the event of a change, you will be informed in advance and the new price will only apply at the next renewal. You may cancel your subscription if you do not accept the new price.
4. Use of the Service
4.1. Authorized use
The Service is intended for personal, non-commercial use. You undertake to use the Service in accordance with applicable laws and these Terms.
4.2. Prohibited conduct
- Posting illegal, offensive, defamatory content or content that infringes third-party rights
- Using the Service for harassment, spam or unsolicited promotion
- Attempting to gain unauthorized access to the systems or data of the Service
- Using bots, scrapers or any automated means to access the Service
- Reselling, redistributing or commercially exploiting the Service or its content
- Impersonating another person
5. User Content
- You retain ownership of any content you publish on Loaded (photos, text, training data).
- By publishing content in community areas, you grant Loaded a non-exclusive, worldwide, royalty-free license to display this content as part of the Service.
- Loaded reserves the right to remove any content that violates these Terms without notice.
6. AI Scanner and Recommendations
Important notice: The AI nutritional scanner provides estimates, not exact measurements. Nutritional information is given for guidance only. SmartCoach AI recommendations do not replace the advice of a healthcare professional or nutritionist.
Loaded shall not be held responsible for the consequences resulting from the use of the AI scanner estimates or SmartCoach recommendations as the sole source of medical or nutritional information.
7. Coaching
Loaded connects fitness coaches and clients through its platform. Loaded acts as a technical intermediary and is not a party to the contract between the coach and the client. Loaded does not guarantee the qualifications of coaches, although a verification and badge system is in place.
8. Personal Data
The processing of your personal data is governed by our Privacy Policy. By using the Service, you accept the terms of that policy.
9. Intellectual Property
The Loaded application, its design, source code, algorithms, brand and content are the exclusive property of Hugo Lafaye. Any unauthorized reproduction or use is prohibited.
10. Limitation of Liability
- Loaded is provided "as is". We do not guarantee that the Service will be free of errors or interruptions.
- Loaded shall not be held responsible for indirect damages resulting from the use of the Service.
- In the event of established direct damages, Loaded's liability is limited to the amount of subscriptions paid by the user during the last 12 months.
- Loaded shall not be held responsible for injuries resulting from the performance of physical exercises followed or suggested via the application.
11. Service Availability
Loaded strives to ensure continuous availability of the Service but cannot guarantee uninterrupted operation. Maintenance, updates or technical incidents may temporarily affect access to the Service. Loaded shall not be held responsible for periods of unavailability.
12. Changes to the Terms
Loaded reserves the right to modify these Terms at any time. Changes will be notified through the application or by email. Continued use of the Service after notification constitutes acceptance of the new terms.
13. Termination
- You may delete your account at any time from the application settings or by contacting contact@loaded.fit.
- Loaded may suspend or terminate your access in the event of a breach of these Terms, without prejudice to any damages.
- In the event of termination, your data will be processed in accordance with the Privacy Policy.
14. Governing Law and Disputes
These Terms are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution. Failing this, the competent courts of the defendant's place of residence will have jurisdiction.
